Design and logo ownership

We come across this topic time and time again in the design industry.

We often hear “I’ve paid my previous designer, but they won’t send me my logo designs, i thought i owned them?” or “My designer never sent me my original design files, now i can’t get hold of them, what do i do?”

So do you or don’t you own them?

And should your designer of sent you the designs OR do they have the right not too?

Okay so looking at the Copyright law it states:

“Normally the individual or collective who authored the work will exclusively own the work and is referred to as the ‘first owner of Copyright’ under the 1988 Copyright, Designs and Patents Act.”

So basically, the designer legally does own the designs. BUT is that ethical, after all – the customer, you have paid for your designs.
